Albuquerque & Rio Rancho Domestic Partnership Agreement Attorney

Domestic Partnership Agreements

Domestic partnerships and LGBT civil unions are not legally recognized in New Mexico, but many couples opt to acknowledge their relationship through a legal agreement based on the state’s current contract laws. The Law Office of Dorene A. Kuffer in Albuquerque can assist you in creating a domestic partnership agreement.

Why a Domestic Partnership?

A domestic partnership agreement is important for couples because it sets forth an understanding about the rules surrounding the financial aspects of your relationship. If a domestic partnership ends, domestic partners do not have the protections of divorce laws. A domestic partnership agreement allows each of you to decide how you want your assets, debts, children, income and expenses to be treated during the relationship and upon dissolution of the relationship, illness or death.

The establishment of wills and trusts is also an important part of domestic partnerships. Drafting a will or trust states exactly how your property and assets are to be distributed upon your death. Without a valid will or trust, New Mexico laws determine how your property is distributed.

Domestic Partnership Law

Often, domestic partnership agreements are drafted by couples who do not wish to get married.  Now that marriage is allowed for all individuals in New Mexico, if you are going to marry, it is important to consult an attorney who is experienced in family law and the particular needs of LGBT persons. This is so especially if you were together with your future spouse for several years prior to getting married. A knowledgeable attorney will be able to advise you on any documents you need to create prior to your marriage.

Other times, a couple shares property, assets and children but do not wish to get married for personal reasons. Whether you are a heterosexual or LGBT couple, a domestic partnership agreement solidifies your relationship.
